| CODES OF PRACTICE FOR (CONTRACTOR) MEMBERS
The Code of Practice represents a binding commitment on the part of each Member Company of the Concrete Repair Association to work towards the highest standards of quality, integrity, safety and reliability.
Each Member shall observe and comply with the following requirements in all of its construction activities, provided that the contract under which he is working is based upon fair and reasonable terms and conditions.
1. STANDARD OF WORKMANSHIP
The Member shall carry out repair works to the highest standard of workmanship and all specialist materials used shall be free from defects and fit for purpose for which they are acquired from companies or individuals which comply with all relevant Health and Safety legislation including in particular the requirements of COSHH.
All workmanship, goods and materials shall comply with the contract requirements and shall be to the satisfaction of the client.
All work shall be monitored regularly to ensure that no defects occur to workmanship or material failings, therefore providing work of the highest standard.
2. EMPLOYMENT
The Member shall take all steps to ensure that all concrete repairs are undertaken by skilled labour permanently employed by the Company.
The Member shall operate a fair and reasonable pay structure for his employees and be a member of a recognised Wage Regulatory Body. The Member shall not discriminate unlawfully or improperly in respect of employment.
3. RECORDS
The Member shall keep acceptable records regularly maintained of all permanently employed labour.
4. QUALITY ASSURANCE
The Member shall be accredited to ISO 9000.
5. SAFETY
The Member shall demonstrate that he is adopting a positive commitment to Safety and at all times is working within the current Health and Safety at Work Act.
6. TRAINING
The Member shall demonstrate a positive commitment to training and shall take all necessary steps to ensure that all operatives and staff receive correct and continuing training in all relevant aspects of the work.
7. SUB-CONTRACTING
The Member shall only employ bona-fide sub-contractors to carry out activities other than Concrete Repairs.
Where repair works are sub-contracted, the Member shall ensure these are carried out by a competent and bona fide company or firm which is adequately insured.
8. BUSINESS INTEGRITY
The Member shall observe the highest standards of business integrity in all of its business dealings, and shall act as a committed member of the Concrete Repair Association
APPLICATION AND ENFORCEMENT OF THE CODE OF PRACTICE
FOR FULL (CONTRACTOR) MEMBERS
The Code of Practice shall form part of the Constitution of the Concrete Repair Association.
1. All Members shall comply with the Association's Code of Practice.
2. No company shall be admitted to membership until it has demonstrated its commitment to quality and integrity to the entire satisfaction of the Executive Committee and until it has formally undertaken to comply with the Association's Code of Practice.
3. In the event that any Member fails to comply with the Code of Practice the Member shall receive a written warning from the Executive Committee together with advice on compliance with the Code of Practice.
In the event of a further repeated failure the Member shall be referred to the Executive Committee and may be either suspended or expelled from the Association.
4. In the event that any other Member or the Executive Committee receives a complaint arising out of an alleged breach of the Code of Practice, the following complaints procedure will be used:
4.1 The Executive Committee will write direct to the offending Member requesting that either the problem is dealt with immediately or the company is represented at sub-committee meeting to discuss and agree a course of action to rectify the problem.
4.2 The offending Member will be given reasonable time to rectify the problem and report direct to the Executive Committee that the matter has been resolved.
4.3 In the event that the matter is not resolved to the entire satisfaction of the Executive Committee the member may he suspended or expelled from the Association.
CODE OF PRACTICE FOR FULL (MANUFACTURER) MEMBERS
This Code of Practice for Full (Manufacturer) Members represents a binding commitment on the part of each Full (Manufacturer) Member of the Concrete Repair Association to work towards the highest standards of quality, integrity, safety and reliability.
Each Full (Manufacturer) Member shall observe and comply with the following requirements in all of its activities associated with the Concrete Repair Industry in order to fully support the Full Members of the Association.
This Code of Practice for Full (Manufacturer) Members forms part of the Constitution of the Association and should be read together with other relevant documents to which the Full (Manufacturer) Members are committed where appropriate.
1. STANDARDS OF PRODUCT
Full (Manufacturer) Members shall ensure that those items which they can provide to the Concrete Repair Industry are of the standard of quality and reliability stated in their technical literature.
They shall be able to demonstrate a clear commitment to such standards so that a satisfactory level of performance is ensured when the products are correctly installed.
Full (Manufacturer) Members shall he able to provide technical representation to Full Members in order to assist with and ensure the correct installation or application of their product.
The Full (Manufacturer) Member shall be accredited to ISO 9000.
2. RECOMMENDATION TO THIRD PARTIES
Full (Manufacturer) Members shall, where reasonably practicable, recommend suitable Full Members of the Association to carry out works of Concrete Repair and allied activities.
Such recommendation shall not relieve the Full Member of any potential contractual commitments, nor shall the Full (Manufacturer) Member be limited in his recommendations solely to Full Members of the Association.
3. SAFETY
Full (Manufacturer) Members will support Full Members in all matters of safety and the safe transportation, storage and use of their products.
All statutory safety requirements shall be complied with.
4. TRAINING
Full (Manufacturer) Members shall demonstrate a positive commitment to the provision of free technical and practical training both on and off site to ensure the safe use and competent application of their products and to enable the repair work to be carried out to the highest standard of workmanship.
5. BUSINESS INTEGRITY
Full (Manufacturer) Members shall observe the highest standards of business integrity. They shall protect the interests of the Association at all times and act as a fully committed Full (Manufacturer) Member of the Concrete Repair Association.
APPLICATION AND ENFORCEMENT OF THE CODE OF PRACTICE
FOR FULL (MANUFACTURER) MEMBERS
The Code of Practice for Full (Manufacturer) Members shall form part of the Constitution of the Concrete Repair Association.
1. Full (Manufacturer) Members shall comply with the Association's Code of Practice for Full (Manufacturer) Members.
2. No company shall be admitted to Full (Manufacturer) Membership until it has demonstrated its commitment to quality and integrity to the entire satisfaction of the Executive Committee of the Association, or to such sub-committee of Full (Manufacturer) Members as the Executive Committee of the Association may appoint and until it has formally undertaken to comply with the Constitution of the Association.
3. In the event that any Full (Manufacturer) Members fails to comply with the
Code of Practice for Full (Manufacturer) Members, the Full (Manufacturer) Member shall receive a written warning from the Executive Committee together with advice on compliance with the Code of Practice for Full (Manufacturer) Members and the Constitution.
In the event of a further repeated failure the Full (Manufacturer) Member shall be referred to the Executive Committee and will be dealt with in accordance with the Rules of the Association.
COMPLAINTS PROCEDURE
This procedure will apply to both Full (Contractor) and Full (Manufacturer) Members.
1. A complaint alleging a breach of the Rules of the Association may be permissible from any bona fide source including a Member, Client or Professional. The Executive Committee will ensure that improper or vexatious claims are excluded from consideration.
2. Any complaints must be made in writing to the Secretary.
3. The Secretary will notify the Member concerned that a Complaint has been received. He will also notify the Executive Committee in writing.
4. The Member will respond to such notification by:
4.1 Action on Site and/or
4.2 Explanation in writing to the Secretary for consideration by the Executive Committee.
5. The Executive Committee shall:
5.1 Acknowledge receipt of the Complaint
5.2 Offer advice and help to the Member
5.3 Seek external advice as considered appropriate
5.4 Record agreed action(s) with the Member
5.5 Follow-up to ensure action(s) taken by the Member (if required)
The time-scale for the above shall be set by the Executive Committee and enforced or amended as appropriate with due regard to all the circumstances.
6. If the Member fails to satisfy the Executive Committee in respect of the cause, responsibility or remedial action required and undertaken, then the Executive Committee will take further action to protect the interests of the Association.
7. In the event that discussions with the Member do not lead to a conclusion acceptable to the Executive Committee on behalf of the Association, the matter will be referred to the next General Meeting for the agreement by the Members of the action to be taken.
8. The Executive Committee will maintain contact with the Complainant if considered appropriate by the Chairman.
9. All complaints received will be dealt with in strict confidence until such time that they require consideration by the General Meeting.
10. The views and opinions expressed by the Executive Committee and the action agreed will be strictly on a 'without prejudice' basis and made with the best interests of the Association in mind. No action taken by the Association or its Officers or Members will be in contempt where legal proceedings are in progress.
11. The objective of the Association and the Executive Committee will be to support the Members wherever reasonably possible to the extent that the Member is able to demonstrate by performance his intent to remedy any complaint found to be of substance by the Executive Committee.
12. The costs of external advisory bodies will be borne by the Association in the first instance (subject to a predetermined maximum commitment) and may be charged to the Member in part or in full as considered appropriate by the Executive Committee, having regard to all the circumstances.
